Transfer of Inherited Property (Intikal) in Turkey

How inherited property passes to heirs: the certificate of inheritance, transfer steps, joint vs. shared ownership, and the sale process.

When a loved one passes away, the real estate they leave behind does not transfer to the heirs automatically; it must first be officially registered in the heirs' names at the land registry. This process is called intikal (transfer of inheritance). Until it is complete, the inherited property cannot be sold, rented, or otherwise dealt with.

What Is Inheritance Transfer?

Intikal is the registration of a property held in the name of the deceased into the names of the legal or appointed heirs. Without it, heirs cannot dispose of the property. It is therefore always the first step for inherited real estate.

How to Obtain the Certificate of Inheritance

The precondition for intikal is the certificate of inheritance. This document, showing who the heirs are and their shares, can be obtained from the civil court of peace or a notary. The notary route is usually faster. Each heir's share ratio is stated clearly.

Steps of the Transfer Process

The process generally follows these steps: obtain the certificate of inheritance, file the inheritance and transfer tax declaration at the tax office, then book an appointment at the land registry to apply for the transfer. Required documents include the certificate of inheritance, heirs' IDs, the property's title details, and the tax clearance document.

Joint Ownership and Sale

Intikal can be done as joint ownership registered to all heirs together, or, if the heirs agree, converted to shared ownership where each heir's share is shown separately. Under joint ownership, all heirs must act together to sell; under shared ownership, each heir may sell their own share separately.

Taxes, Fees and Key Points

Inheritance and transfer tax is based on the property's value and the heir's degree of kinship and can be paid in installments. A transfer fee is also collected at the registry. Since delays may cause penalties, watch the declaration deadline after obtaining the certificate. If heirs disagree, professional and legal support is the safest path.
